Main differences between B105™–2017 and B105™–2007

Summary:

The main differences between B105-2017 and B105-2007 include updates to better reflect its use for less complex projects. The title has been changed to “Standard Short Form of Agreement Between Owner and Architect.” The 2017 version adds language accurately stating the architect’s standard of care, consistent with other AIA agreements. It also includes a limited license for the owner to use the architect’s instruments of service and a termination provision one year from substantial completion.

 

To better reflect that B105—2017 is intended to be used on less complex projects, where use of a short form of contract may be appropriate, the title has been changed from Standard Form of Agreement Between Owner and Architect for a Residential or Small Commercial Project to Standard Short Form of Agreement Between Owner and Architect. 

Other changes to the document include:

• Language accurately stating the architect’s standard of care has been added. The standard of care language is now consistent with the standard of care language in the other AIA owner/architect agreements. 

• Included new language indicating that any changes the Owner and Contractor make to A105™—2017, Standard Short Form of Agreement Between Owner and Contractor, will not affect the Architect’s services unless the Architect subsequently agrees to amend its agreement with the Owner. 

• Language is added providing the Owner a limited license to use the Architect’s Instruments of Service solely as a point of reference for maintaining, altering and adding to the Project. The Owner, however, as a result of its continued use of the Architect’s Instruments of Service without retaining the Architect, must agree to indemnify the Architect for the Owner’s use.
