AIA Document A104—2017 is an updated version of, and has replaced, AIA Document A107—2017. The new document better reflects its intended use and its coordination with AIA Document B104—2017, Standard Abbreviated Form of Agreement Between Owner and Architect.
AIA Document A104—2017, Standard Abbreviated Form of Agreement Between Owner and Contractor, has been coordinated with key revisions included in the 2017 Owner-Contractor Agreements and AIA Document A201®—2017, General Conditions of the Contract for Construction. A few of the key changes are discussed below:
- The title of the document has been changed to A104—2017, Standard Abbreviated Form of Agreement Between Owner and Contractor to better reflects that A104—2017 may be used on projects where an abbreviated form of agreement may be appropriate. The document number has been changed to allow for easier identification with B104—2017, Standard Abbreviated Form of Agreement Between Owner and Architect, which is the companion document to A104—2017.
- Checkboxes have been added that clarify key contract dates. As an example, the format for the date of commencement of the work has been changed to a checkbox allowing the parties to select either (1) the date of the Agreement, (2) the issuance of a notice to proceed (NTP) by the owner, or (3) a different date as agreed by the parties. Additionally, a checkbox has been added so that the parties can select whether Substantial Completion of the entire Work will be achieved no later than a specified calendar date or within a certain number of days from the date of commencement.
- Allows for E204™–2017, Sustainable Projects Exhibit, and any applicable Sustainability Plan to be incorporated as a Contract Document when used on a Sustainable Project.
- Recognizing the expanded use of email and other forms of electronic communication, the provisions describing notice have been clarified to require that all notices under the Contract must be provided in writing, which may include electronic communication by email as specified by the parties.
- When used on Cost of the Work Projects, the provisions for the calculation of progress payments have been clarified and simplified to clearly delineate the basis for each progress payment.
- The insurance section has been expanded and modified to track the insurance requirements set forth in the other 2017 Owner-Contractor Agreements.
