Instructions: G746™ – 2024 Authorization to Proceed with Early Release Work

Synopsis.

AIA Document G746™–2024 is a new document that provides authorization for the Design-Builder to begin Early Release Work on a design-build project. AIA Document A141®–2024 defines Early Release Work as “limited, predetermined portion of the Project or scope of the Work that the Owner authorizes the Design-Builder to commence before the parties execute the Design-Build Amendment.” G746–2024 allows the parties to describe the terms of how the Early Release Work shall proceed, including payment terms, insurance requirements, and warranty requirements, if they differ from the Agreement.

Date. The date represents the date the Authorization becomes effective. It may be the date an original oral agreement was reached, the date the Authorization was originally submitted to the Owner, or the date authorizing action was taken or the date of actual execution.

Project. Describe the proposed Project in sufficient detail to identify: (1) the official name or title of the facility; (2) the location of the site; (3) the proposed building usage; and (4) the size, capacity or scope of the Project.

Parties. Parties to the Authorization should be identified using the full address and legal name under which this Agreement is to be executed, including a designation of the legal status of both parties (sole proprietorship, partnership, joint venture, unincorporated association, limited partnership or corporation [general, limited liability, close or professional], etc.). Where appropriate, a copy of the resolution authorizing the individual to act on behalf of the firm or entity should be attached. Other information may be added, such as telephone numbers and electronic addresses.

§ 1.1 Insert a description of the scope of the Early Release Work to be performed or attach a description to the Authorization.

§ 1.2 Identify the Specifications applicable to the Early Release Work.

§ 1.3 Identify the Drawings applicable to the Early Release Work.

§ 1.4 Identify any additional documents applicable to the Early Release Work.

§ 2 Insert any schedule requirements for the Early Release Work.

§ 3 Insert the method of compensation and how the compensation is to be calculated for the Early Release Work, if not set forth in the Agreement.

§ 4 Indicate any payment terms applicable to the Early Release Work that differ from those set forth in the Agreement.

§ 5 Indicate any retainage terms applicable to the Early Release Work that differ from those set forth in the Agreement.

§ 6.1 Indicate any insurance requirements applicable to the Early Release Work that differ from those set forth in the Agreement.

§ 6.2 Indicate any other insurance coverage to be purchased or maintained by the Design-Builder or Owner for the Early Release Work but not otherwise required by the Agreement.

§ 6.3 Indicate any bond requirements applicable to the Early Release Work that differ from those set forth in the Agreement.

§ 7 Indicate any warranty requirements applicable to the Early Release Work that differ from those set forth in the Agreement.

§ 8 Identify any terms and conditions related to the Early Release Work that differ from the terms and conditions of the Agreement

Executing the agreement.

The persons executing AIA Document G746–2024 should indicate the capacity in which they are acting (i.e., president, secretary, partner, etc.) and the authority under which they are executing the Agreement. Where appropriate, a copy of the resolution authorizing the individual to act on behalf of the firm or entity should be attached.

Notes.

Modifications. Particularly with respect to professional or contractor licensing laws, building codes, taxes, monetary and interest charges, arbitration, indemnification, format and font size, AIA Contract Documents may require modification to comply with state or local laws. Users are encouraged to consult an attorney before completing or modifying a document.
